1. Family sponsored immigration may include the following:

  • Immediate relatives,
  • Widow(er)s,
  • VAWA petitioners (battered spouses, children or parents),
  • Spouse, parent, or child of member of Armed Forces who died in combat.

Preference system – Preference system is divided between following family preferences:

  • First Preference – Unmarried sons and daughters of United States Citizens;
  • Second Preference – Spouses and unmarried children and sons and daughters;
  • Third Preference – Married sons and daughters of United States Citizens;
  • Fourth Preference – Brothers and Sisters of United States Citizens.

For relative preference petitions, the priority date is the date the I-130 petition is properly filed with the USCIS in the U.S. or when permissible abroad. Certain petitions automatically convert to others but retain, if relevant, their original priority date.

2. K-1 Visa:

K-visa is obtained for a fiancé(e)s. The criteria for obtaining K-1 visa is:

  • A fiancé(e) of a U.S. citizen;
  • Seeks to enter U.S. solely to conclude a valid marriage with petitioner;
  • Marry within 90 days after entry;
  • Minor children of fiancés can accompany them (K-2)
    United States Citizen files I-129 F petition with USCIS. Must provide proof that:
  • There is a bona fide intention to marry within 90 days of fiancé’s entry;
  • No legal impediments to marry;
  • Have previously met in person within 2 years of filing petition. USCIS may waive the in-person requirement if it would cause “extreme hardship” to the petitioner or would “violate strict and long established customs of the beneficiary’s foreign culture or social practice.” 8 C.F.R. §214.2(k)(2);
  • Petitioner must provide criminal records, if any;
  • Distinction between proving intention to marry and closeness of relationship.
